1. Service Description
CakeVision provides an AI-powered cake design and ordering platform for bakeries ("Service"). Bakeries ("Bakers") use the Service to deploy a customer-facing design tool where their customers can answer guided questions, generate AI cake mockups, refine designs in real-time, and submit orders. CakeVision facilitates the design and ordering process but does not process payments or guarantee the fulfillment of any orders.
2. User Accounts
To use CakeVision as a Baker, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old or have the legal authority to bind your business to these terms. You agree to provide accurate, current, and complete information during registration.
3. AI-Generated Content
CakeVision uses artificial intelligence (Google Gemini) to generate cake design images based on user inputs. AI-generated designs are reference mockups only and do not represent a guarantee of the final product. The actual cake may differ from the generated design. CakeVision makes no warranty regarding the accuracy, quality, or feasibility of AI-generated designs. Generated images may be stored for the purpose of order fulfillment and service improvement.
4. Acceptable Use
You agree not to use CakeVision to: upload or generate content that is illegal, harmful, or offensive; attempt to reverse-engineer, decompile, or exploit the Service; use automated tools to scrape, crawl, or extract data from the Service; impersonate another person or entity; or interfere with the operation or security of the Service. CakeVision reserves the right to suspend or terminate accounts that violate these terms.
5. Intellectual Property
The CakeVision platform, including its design, code, and branding, is the intellectual property of CakeVision. AI-generated cake designs created through the Service may be used by both the Baker and their customers for the purpose of cake ordering and production. Bakers retain ownership of their uploaded content (logos, images, business information). CakeVision does not claim ownership of Baker or customer content.
6. Limitation of Liability
CakeVision is provided "as is" without warranty of any kind. To the maximum extent permitted by law, CakeVision shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. CakeVision is not responsible for disputes between Bakers and their customers regarding cake orders, quality, or fulfillment. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
7. Changes to Terms
CakeVision reserves the right to modify these Terms of Service at any time. We will notify registered users of significant changes via email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you may close your account at any time.
